1 – INTRODUCTION

The detailed general terms and conditions below (hereinafter referred to as the "General Conditions") govern the contractual relationship between any user (hereinafter referred to as the "Customer" or "You") of the website www.coklat-ibiza.com (hereinafter referred to as the "Site") and the commercial entity Coklat-Ibiza SL, located at Calle del Rio 31, Nascira, Bl 4.2.3 - 07840 Santa Eulalia – Spain, registered with the Barcelona Trade and Companies Register under the number B64380520 (hereinafter referred to as "Coklat-Ibiza").

These General Conditions are the only ones applicable and replace all other General Conditions, except for express and prior written derogation. Coklat-Ibiza reserves the right to modify certain provisions of these General Conditions, requiring them to be reread before each visit to the Site.

 

These changes will be effective when posted on the Site and will not apply to contracts concluded prior to their posting. Each purchase on the Site is governed by the General Conditions applicable on the date of the order. By validating your order, we consider that you accept our General Conditions without reservation after having read them.

By accessing the Site, you agree to comply with the terms of use contained therein.

2 – PLACING AN ORDER

The Site is intended for individual customers wishing to purchase Coklat-Ibiza products.

To place an order, you can use two methods:

3 – PRICES

The sale prices indicated on the Site are expressed in Euros including VAT but exclude shipping costs, which are your responsibility. The amount of shipping costs will be displayed in the shopping cart at the time of order validation and added to the total amount to be paid.

We reserve the right to modify the prices displayed on the Site at any time and without notice, but we undertake to apply the rates displayed on the Site at the time of your order.

4 – AVAILABILITY

The availability of the ordered products is displayed on the Site in real-time but cannot be guaranteed.

In the event that one or more of the ordered products are no longer available at the time of the order, we undertake to contact you within 72 hours to propose an exchange with equivalent product(s) or the refund of the unavailable product(s).

5 – DELIVERY METHOD

Products purchased on the Site are delivered worldwide.

Your order will be delivered to the delivery address you provided during your order.

Your order will be processed and shipped within 7 days after the validation of your payment, by the means of transport provided for the delivery country.

Coklat-Ibiza undertakes to make every effort to meet the shipping deadlines indicated on the Site. Once the package(s) is/are handed over to the carrier, Coklat-Ibiza cannot be held responsible for the consequences of a delivery delay or loss of packages caused by a third party, resulting from an error in the delivery address provided by the User or an unforeseeable and insurmountable cause constituting a case of force majeure.

In case of non-receipt of one or more packages within the timeframe indicated by the carrier, an investigation will be carried out with the carrier. This investigation can take from a few days to several weeks, depending on the chosen transport provider. During this period, no refund will be made.

Upon receipt of your order, we recommend making reservations if one or more packages appear to have been opened or damaged. We also recommend checking the conformity of the delivered products with your order and immediately reporting any anomalies you may notice.

Subject to applicable legal guarantees, you must inform us of any reservations made or non-compliance of the delivered products with your order within 24 hours of receiving the order, by mail to Coklat-Ibiza, Customer Service, Calle del Rio 31, Nascira, Bl 4.2.3 - 07840 Santa Eulalia – Spain , or by email to admin.coklatibiza@gmail.com. After this period, the delivered goods will be deemed to be in conformity with the order.

The return of goods will only be possible after receiving your letter or email and our acceptance of the return of goods. Shipping costs are at the User's expense.

In case of confirmation of the non-compliance of the delivered goods with the order, Coklat-Ibiza will proceed with the replacement and refund of the return costs paid by the user.

If the delivered package(s) have been subject to reservations upon receipt and if certain goods have been damaged due to the fault of the carrier, Coklat-Ibiza will conduct an investigation and attempt to claim compensation from the carrier's insurance.

In this case, Coklat-Ibiza's liability cannot be engaged, no refund will be made, and the replacement of damaged goods can only be made after formal acceptance by the carrier or its insurer to bear the cost of replacement.

6 – PAYMENT METHOD

Coklat-Ibiza offers 2 payment methods:

Credit card (Visa, Mastercard). Secure payment by Paypal®

Debit from your Paypal® account (secure payment)

Online credit card payment is made via the Paypal® service, which uses SSL encryption to protect your banking information when transmitted over the Internet.

Your order will be processed once we receive confirmation of your payment from Paypal®.

The goods remain the property of Coklat-Ibiza until full payment of the invoice amount.

7 – RETURNS

The customer has a period of 24 hours after receiving the goods to identify any defects. In this case, they must send us an email to admin.coklatibiza@gmail.com to inform us of the defect. Returns of goods are only possible after formal and written acceptance by Coklat-Ibiza.

Returned packages must be shipped with acknowledgment of receipt, by the carrier of your choice.

Shipping costs are at the customer's expense.

8 – DISPUTES AND LIABILITY

Coklat-Ibiza cannot be held responsible for the non-performance of the sales contract in case of force majeure, particularly due to the malfunction, following a total or partial strike, of postal services and means of transport or communication.

Once the packages have been delivered and checked by the customer as in accordance with the order, Coklat-Ibiza cannot be held responsible for the deterioration of the products sold due to mishandling by the Customer or the end-user.

This contract is subject to Spanish law.

9 – PERSONAL DATA PROTECTION

There are two cases that may lead to the recording of your personal data:

You make a purchase on our site and must provide us with your personal information for the smooth progress of the order (name, first name, email address, billing and shipping addresses, etc.).

You register on our site to receive our newsletter and promotions.

By registering on our site, you agree to provide us with sincere and truthful information about yourself.

The proven communication of false information, contrary to these General Conditions and the terms of use of the site, will result automatically and without notice in the termination of the User.

The European Commission offers an online dispute resolution (OS) platform. This platform is available at http://ec.europa.eu/consumers/odr/. As a customer, you always have the option of contacting the arbitration board of the European Commission.

We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
