1 - INTRODUCTION

The General Terms of Sale detailed below govern the contractual relationship between the User (hereinafter referred to as "Client" or "You") of the website www.coklat-ibiza.com (hereinafter referred to as the "Site") and the business entity Coklat -Ibiza SL , located at Calle Capitan Arenas 42-46, 6° 2a, 08034 Barcelona - Spain and registered in the Trade and Companies Registry of Barcelona under the number B64380520 (hereafter "Coklat -Ibiza").

These General Terms of Sale are the only ones applicable and replace all other terms and conditions, unless a written express derogation. Coklat -Ibiza reserves the right to modify certain provisions of these General Terms of Sale, requiring them to be reread before each visit to the Site. These changes will be valid as they are posted on the Site but will not apply to contracts concluded earlier. Each purchase on the Site is governed by the General Terms of Sale applicable to the date of the order. We consider that, by confirming your order, you unreservedly accept our General Terms of Sale after having read them.

By accessing the Site, you agree to the Terms of Use contained therein.


2 - PLACING ORDERS

The Site is aimed to individual customers willing to buy Coklat–Ibiza’s products.

Therefore, to be able to place an order you can either register by providing your details or simply as a guest indicating your billing and shipping directions during the checkout process.

To place an order, you can use two ways:


3 - PRICES

The prices listed on the Site are in Euros including VAT, but exclude shipping costs at Client's charge. The amount of the shipping costs will be displayed in the shopping cart at the time of confirmation of the order and added to the total amount payable.

We reserve the right to change the prices listed on the Site at any time and without notice, but we are committed to apply the prices listed on the Site at the time of your order.


4 - AVAILABILITY

The availability of ordered products is indicated on the Site in real time but can not be guaranteed.

In the event that one or more of the products ordered would no longer be available at the time of the order, we would contact you within 72 hours to propose an exchange with equivalent product(s) or a refund for the product(s) out of stock.


5 - DELIVERY MODE

Products purchased on the Site are delivered worldwide.

Your order will be delivered to the delivery address provided when placing your order.

Your order will be processed and shipped within 7 days after confirmation of payment by the means of transport provided for the country of delivery.

Coklat-Ibiza is committed to do its best effort to meet shipping deadlines listed on the Site. However, once assigned to the carrier, Coklat -Ibiza can not be held responsible for the consequences of a late delivery or loss of a package caused by a third party, resulting from an error in delivery address provided by the Client or some unforeseen causes constituting a case of force majeure.

In case of non-reception of one or more packages in the delay specified by the carrier, an investigation will be conducted with the carrier. This investigation may take several days to several weeks, depending on the provider of transport. During this period, no refund will be made.

Upon reception of your order, we recommend you to make reserves if one or more packages appear to have been opened or damaged. We also recommend you to check the conformity of the goods delivered with your order and immediately report to us any discrepancies you may find.

Subject to applicable legal guarantees, you must inform us of any reserves or non-conformity of goods with your order within 24 hours of reception of the order by postal mail, writing to Coklat-Ibiza , Customer Care, C/Capitan Arenas 42-46, 6° 2a, 08034 Barcelona - Spain or email at contact@coklat-ibiza.com. After this delay the goods delivered will be deemed to comply with the order.

The return of goods is only possible after reception of your postal mail or your e-mail and our acceptance of the return of goods. The shipping costs are at Client’s charge.

In case of confirmation of the non-conformity of goods delivered with the order will replace the goods concerned and reimburse the shipment paid by the Client.

If reserves have been done upon receipt and if some goods have been damaged by the fault of the carrier, Coklat-Ibiza will investigate and attempt be indemnized by the carrier’s insurance. In this case, the responsibility of Coklat -Ibiza not being in cause, no refund will be made and the replacement of damaged goods will only be done after formal acceptance of the carrier or its insurer to cover the cost of replacement.


6 - PAYMENT

Coklat -Ibiza offers 2 payment methods :

  • - Credit Card (Eurocard , Visa, Mastercard). Secure payment by PayPal®
  • - Payment with your Paypal® account (secure payment)

Payment "on line" by credit card is done via PayPal® service that uses SSL "Secure Socket Layer" encryption to protect your credit card information when transmitted over the Internet. Your order will be processed once confirmed your payment by PayPal®.

Goods sold remain the property of Coklat-Ibiza until full payment of invoices.


7 - RETURNS OF GOODS

The customer has a 24 hours delay after reception of the goods to report any defect. In this case he must send us an email to contact@coklat-ibiza.com to inform us of the defect. Merchandise returns are possible only after formal written acceptance of Coklat-Ibiza.

Returned packages must be sent with acknowledgement of receipt by the carrier of your choice.

The shipping costs are at Client’s charge.


8 - DISPUTES AND LIABILITY

Coklat-Ibiza can not be held responsible for non-execution of the contract of sale in case of force majeure, in particular in case of a malfunction, due to a total or partial strike, of postal services, transports and communication.

Once the packages delivered and verified by the Client as complying with the order, Coklat-Ibiza can not be held responsible for the degradation of the products sold due to mishandling by the Customer or End User.

This contract is subject to Spanish law .


9 - PROTECTION OF PERSONAL DATA

Orders on the site are reserved to business customers. Thus registration on our Site is mandatory to be able to see prices and place orders.

By registering on our Site, you agree to provide us with sincere and true information about yourself and your company. Establishing a Client would have been provided false information, contrary to these General Terms of Sale, the Client’s account would be terminated ipso facto with neither notice nor compensation.

In accordance with the Spanish “Organic Law” 15/1999 of Protection of Personal Data, the processing of Personal Data is being declarado to the Spanish Data Protection Agency. In accordance with European texts and Spanish laws you have a permanent right to access and correct your own data.

If you agreed, when registering on the Site or subsequently, to receive promotions and information about our products by e-mail, offers will be sent to you.
